2007 To Whom It May Concern I was hired as an Audio Engineer at Surya Unlimited Inc to produce audio CDs, owned by Dr. Devra West. I began my employment first as an independent contractor in early May of 2006 and was brought on full time by mid June 2006 as the Technical Director. When I first came to work at the Lakeside location, there was talk around the office on numerous occasions that Dr. Cole had slipped and fallen on some icy stairs at the condominium where she was living at the Cherry Creek Condominiums in Lakeside. It is my understanding that the accident had happened sometime during April 2006. Dr. Cole had been sharing the condominium with a roommate and I knew the guy and his girl friend. At the time, Pat Cole was a volunteer at our office who came in to fulfill obligations that were owed to Dr. Devra West, by the non- profit for which she was president. Dr. West is the owner of the company that employed me. The information about Dr. Cole's accident came from Pat herself, so I saw no reason to question the validity of the information. Pat discussed with our staff that she was considering filing a personal injury lawsuit due to the accident because of the liability of the owner of the condominium. The stairs that she fell down, are two flights of very steep stairs that wind down from the upper level garages to the front door of water front condo. I also heard talk that Dr. Cole had taken pictures of the head injuries in order to pursue her personal injury law suit. This hub-bub of conversation went on at our office, on and off for several weeks and outside of discussing the matter relative to suing the condo people, I didn't pay much attention to whether or not Dr. Cole followed through with a suit. During the ensuing months, I came to discover that Dr. Pat Cole had engaged in serious levels of financial mismanagement, misappropriations outright embezzlement and theft at Dr. West's company. I saw the documents and records that substantiated and proved the mishandling of monies myself because as an IT employee, I had access to the company's files and I was working on organizing a filing system for invoices and financial records. I was shocked and amazed at the extent to which Dr. Cole had taken money behind Dr. West's back and also had not paid the bills she owed to Dr. West and then tried to cover her tracks. Dr. West didn't find out about this until later because she had been out of state with her elderly father who had taken ill and passed away. In addition to the accident on the stairs at her condo, Pat Cole also told us about her getting lost in the dark in the cherry orchard near her condo and falling down and rolling down the hill and getting banged up pretty bad, nothing serious but getting banged up from rolling down the hill in the dark. She didn't go to the doctor or anything. Pat Cole liked getting attention so she pretty much told anyone who would listen about the accident, so the whole group of us heard all about it, including Dr. West. In October 2006, Dr. Cole came up with a wild story about Dr. West, claiming that Dr. West had assaulted her, abused her and so on. I know this was a pile of bunk because Dr. West is tiny woman only 5'1', who was recovering from a broken leg and had spent the previous spring in a wheel chair and the summer-fall months on crutches and walkers. She also had a heart condition and is in very frail condition in general. She can't even carry her own groceries and requires help getting in and out of our office building. From my point of view and plain gut-instincts the whole story wasn't even physically possible. Also at no time did Pat Cole ever so much as even infer that she was unhappy with Dr. West. She always seemed very happy to see Dr. West We also all knew that this was a ploy and total mind game on Dr. Cole's part to discredit Dr. West to get out of the fact that she owed Dr. West over $750,000. It is also impossible that Dr. West abused Pat Cole at any time at the office because I was there five days a week and never saw or heard anything of the sort. Nothing stacked up in even the slightest possible detail. If anything, Dr. West was overly kind and patient with Dr. Cole as well as with the rest of us. Also, we have an open concept office design and Dr. West's personal office is completely exposed to the rest of the room. There's just no way any sort of abuse or or even unpleasantly could have been going on without the rest of the staff seeing it. The whole thing was so far fetched that is absurd. In February 2007, Rebecca showed me some pictures of Dr. Cole having a head wound and blood all over her sweatshirt, that supposedly were of injuries from her claim in October. I immediately told Rebecca that the blood on the shirt was not consistent with what Pat Cole was claiming, plus Pat never wore sweat shirts to the office, she wore business attire. We all knew that the photos were phonies and as it turns out they were not even taken during the time that Pat Cole claims her abuse incident had taken place. It is also my absolute belief that Rebecca knows very well what was really going on. We all did. I think it is really bad news and disgusting that Rebecca would use this pile of B.S. to try to claim that our office is anything other than an ordinary work place, just to file a bogus harassment to get a windfall of easy money. If anything, our office is far better than most that I have worked at. In fact, the only one who was in a bad mood on our staff was Rebecca herself and we all figured this was because of her personal problems with her boyfriend. I can attest that Dr. West has always been nice and respectful to me and to every one else and that nothing unusual has ever taken place of any sort since I came on board last May. I am very disappointed that Rebecca would pull such a stunt to someone as nice as Dr. West. I am sorry I am even writing this, but I think it is a really low shot to go to such lengths to manipulate the already obvious. Its a dumb ploy and an even dumber story. Pat Cole did indeed have two accidents and injuries, but Dr. West had nothing to do with it.
